Prayagraj: The Allahabad High Court has granted bail to the accused, convicting the victim in September 2024 in the rape case in Noida. Justice Sanjay Kumar remarked during the hearing that the woman herself has invited the crisis. The incident took place in September 2024. A student of a popular university in Noida went to Hauz Khas in Delhi with three friends. There he met some familiar friends.
In the complaint lodged with the Noida police, the victim said that she was intoxicated. So the accused was trying to get close to me. We were at the bar till three o’clock. He was asking me to come with him. On his request, I agreed to go to his house to rest. Until we reached home, he kept touching me improperly. In addition, he took me to his relative’s house in Gurgaon instead of taking me to his house in Noida. Police said that the victim also said that she was also raped there.

After the incident, she reached the police and lodged an FIR at Noida police station. According to this FIR, the accused was arrested on 11 December 2024. The accused told the court in her bail application that the victim needs rest, so she herself went to my house and agreed to rest.
The court expressed its opinion
However, it can be concluded that she herself invited the crisis and she herself was responsible for it. The victim has also taken a similar stand in her statement. The court said that his medical examination found that his vaginal was torn, but the doctor did not express any opinion about sexual harassment. The court said that the victim was a postgraduate student and so she was able to understand the action taken by her. Considering the facts and circumstances of the case as well as the nature of the crime, evidence, involvement of the accused and the arguments of the lawyers of the parties, I think the applicant has presented a suitable case for bail. Therefore, the bail application is approved.
