Why did the High Court judge say that the victim was in crisis: Supreme Court

New Delhi: A judge of the Allahabad High Court made objectionable remarks in a rape case, on which the Supreme Court is automatically taking cognizance. In such a situation, the Supreme Court took cognizance of the objectionable remarks of another judge of the same High Court and asked that what does it mean that the rape victim herself has created a problem? Why did the judge make such a comment?

A bail petition was filed in the Allahabad High Court by the rape accused, which was approved by the High Court judge, who said that the complainant had drunk and went to the accused’s house and had caused trouble himself. The High Court later granted bail to the accused in the case. Earlier, the judge of the same High Court had said in a rape case that tearing the lower part of the pajama or touching the victim would not be considered to be an attempt to rape. Taking cognizance of this comment, the Supreme Court was automatically hearing with cognizance.

A bench of Supreme Court Justice BR Gawai and Justice Augustine George, who was hearing the self -inspired case, noticed the comments of another judge. The bench said that another judge of the same High Court has passed another order, if a judge wants to give bail then it can give, but why should it be seen that the victim herself had brought the problem? Caution should be taken before observing this type of observation. Self -cognizance case will now be heard after four weeks.

Earlier, the Supreme Court said, “How can one show such insensitivity?” Now the Supreme Court has taken a tough stand on the statement of another judge in this case. Recently, while hearing a bail application, a bench of the Allahabad High Court said in its order to grant bail that after hearing the arguments of the lawyers in this case and investigating the case, I feel that the victim is a student of MA, so the victim is able to understand what morality is, she should also know what she is doing. Even if we accept the victim’s allegations as true, it is true that the victim has brought this disaster and she is also responsible for it.
