But when someone stays in a relationship with someone for years after promising marriage and then goes back on his word, then it is not only a heartbreak but can also be considered a big betrayal in the eyes of the law. One such case has come to light from Karnataka, on which the Karnataka High Court has given a very important decision.

After all, what is the whole matter?

The story is of a woman and a policeman. Both loved each other and their relationship lasted for about 7 years. The woman alleges that during this time the policeman had made a firm promise to marry her. Trusting this promise, the woman also remained in physical relationship with him. Everything was going well, but the story took a turn when the woman told the policeman that she belonged to the Dalit community.

The woman says that as soon as her caste was known, the behavior of the policeman changed. She suddenly refused to marry. Her argument was that her family would never agree to this marriage.

When things did not work out, the woman lodged a complaint against the policeman under fraud and other sections. Seeing the seriousness of the matter, the police also wrote an FIR.

When the policeman reached the High Court

After the FIR was registered against him, the policeman went straight to the Karnataka High Court. He appealed to the court to cancel the FIR registered against him as the case was false.

What did the High Court say?

The bench of Justice M Nagaprasanna heard this case. After hearing the arguments of the policeman, the court clearly refused to cancel the FIR. The court said in very clear words that if a person has physical relations with a woman for a long time with the promise of marriage and later backs out just because he comes to know the caste of the woman, then it prima facie amounts to a case of fraud.

The court accepted that the accused played with the woman’s emotions and trust. Having a relationship with someone on the pretext of marriage and then backing out is a serious crime in the eyes of the law. The court said that this matter should be thoroughly investigated and the truth should come out. Therefore, the FIR cannot be cancelled.

This case is a big lesson for those who take the promise of marriage lightly and put one’s caste above the relationship. This decision of the court gives a strong message to the society that doing so is a fraud in the eyes of the law.
