From time to time, such cases come up where the sons take the property of the parents, but turn away from taking care of them. In old age, when parents need the most support, they struggle with loneliness and financial crisis. One such case recently came up in the Patna High Court, in which the court gave an important verdict.

What was the matter?

The case is related to an elderly couple whose youngest son and his wife forcibly captured their property.

  • The elderly parents had filed a complaint under the Maintenance and Welfare Act, 2007 of senior citizens.
  • He had demanded that the son and daughter -in -law be evicted from his house.

High court decision

The Patna High Court quashed the order given by the former tribunal and single judge in the case.

  • The court clarified that the son cannot be evicted under the Senior Citizen Act, but
  • He will now have to pay rent every month in lieu of possession of the property of the parents.

What instructions did the court give?

  • The court sent the case to the District Magistrate of Patna and ordered that
    • Proper fare should be determined for the property part.
    • Son and daughter -in -law should be ordered to pay rent regularly.
  • Along with this, the court allowed parents to allow
    • They can resort to the competent court to evict the persons of the occupied people if they want.

Chief Justice’s comment

In the decision given on Wednesday, the Chief Justice of Patna High Court dismissed the appeal and said that

  • Those who do not take care of their parents and forcibly occupy their property,
  • They have to pay least rent so that parents can get some financial relief.
