The Kerala High Court has issued summons to him. This summons is in the context of a petition challenging his victory, which has now given a new legal turn to the entire matter.
This petition is two advocates – Of. Sreedharan and K.K. R. Sasikumaran – has filed. He argues that Priyanka Gandhi’s brother and former Wayanad MP Rahul Gandhi ‘strategically delayed’ in resignation from his seat. In fact, Rahul Gandhi won the Lok Sabha elections from both Rae Bareli and Wayanad seats in Amethi. According to the rules, he had to leave a seat, for which he was given a certain time limit. He chose Rae Bareli seat and left the Wayanad seat later.
The petitioners allege that Rahul Gandhi deliberately resigned from the Wayanad seat so that the Election Commission would not get enough time to issue the by -election notification there. The alleged purpose of doing so was to benefit Priyanka Gandhi, because if the notification had come first, she might have been busy with another seat or it would have been difficult to compete. The petition also alleged that Rahul Gandhi’s resignation from Wayanad and then Priyanka’s way of contesting elections was against the election rules, which gave Priyanka Gandhi a ‘non-judged’ benefit in the election.
The Kerala High Court has now issued summons to Priyanka Gandhi Vadra, taking cognizance of these arguments.
