A lot changes in the life of any couple after marriage. From home to lifestyle, even small and big things change. Husband and wife have some rights on each other, but does the wife have any right on her husband’s earnings? This is a very interesting thing. About which women should be aware.

According to Sections 24 and 25 of the Hindu Marriage Act, women are entitled to two types of financial assistance: interim maintenance and permanent maintenance. For interim maintenance, the husband is required to provide details of his income and assets.

For permanent maintenance the husband is required to pay to his wife an amount determined by the court.

If the husband refuses to disclose the details or source of his income, the wife has the benefit of filing a Right to Information (RTI). To provide further protection to wives, the Income Tax Department (based on the directions of the Central Information Commission) is empowered to obtain from the wife a simple statement of net taxable income/total income of her husband within 15 days.

The wife has no direct or proprietary right over her husband’s earnings, but she has a right to maintenance, which is based on his income.

If the wife is unable to pay alimony, she can request the court to order her husband to pay her a reasonable monthly amount determined based on his income. Apart from this, the wife also has the right over her husband’s ancestral property.
