Mrs. Revati Mohite Dhare and Ms. A bench headed by Prithviraj Chavan wanted to know whether the EOW was serious about investigating the case as the charge sheet had not been filed despite the case being registered in October 2020. In its order dated December 17, the court said this is a classic example of the Economic Offenses Wing discouraging investors.

It took four years to file the common charge sheet against the accused. More than 600 investors are involved in this case and are waiting for the investigation to be completed soon. The investigation cannot continue for years. There are also investors who are senior citizens and have invested lakhs of rupees.

The court said that it is the duty of the police to complete the investigation as soon as possible but the charge sheet has not been filed yet. The police have violated the investors’ right to complete the investigation quickly.

Investors are forced to run in front of various officials. Whereas it is the duty of the statutory authority to take appropriate action. The court reminded Chief Public Prosecutor Hiten Venegaonkar of the section of law that provides for action against officers who do not file charge sheets in time.

We do not apply Aklam because Venegaonkar has said that the charge sheet will be filed soon. Seeing the way the investigation of the case has been going on for four years, we told the government lawyer that if the police are not interested in investigating the case or filing the charge sheet, then we should hand over the investigation to the SIT. Keeping in mind our resentment, the Public Prosecutor has said that the charge sheet will be filed within four weeks after receiving instructions from Unit-8 of the Economic Offenses Wing. “This statement is accepted and the hearing is fixed for January 28, 2025,” the order said.
