Jharkhand High Court’s tough question to the government is that the draft is ready, then why the hesitation in implementing the PESA Act?

News India Live, Digital Desk: It has been more than 20 years since Jharkhand became a separate state, but the battle for the rights of “water, forest and land” for which this state was formed is still being fought in the courts. talking is happening PESA Act of, i.e. ‘Panchayat Provisions (Extension to Scheduled Areas) Act’.

This law gives real power to tribals and village councils. But sadly, till date its rules have not been fully implemented in Jharkhand. Now Jharkhand High Court Has slammed the government on this delay.

What did the Chief Justice ask?
During the hearing, the Chief Justice of the High Court bluntly asked the government that when you have prepared the draft and have also sought suggestions from the public, then why is there so much delay in finalizing and implementing it?

The court clearly said that we need concrete answers as to when this law will come into force.

Why is PESA Act necessary?
If you are thinking that this is just a government paper, then it is not so. The implementation of PESA Act means:

  1. Gram Sabha at the top: Decisions on village development will not be taken in Ranchi or Delhi, but in the village Chaupal (Gram Sabha).
  2. Rights on resources: Gram Sabha will decide the use of sand, land and forest in tribal areas.
  3. Ground return: If a tribal’s land has been taken fraudulently, then under the PESA law he gets the power to get it back.

This is the reason why the tribal society of the state has been demanding this for a long time.

What is the government saying?
Hemant Soren The government says that they are working on it. The Advocate General told the court that about 300 suggestions have been received on the draft of PESA rules and the government is considering them so that when the law is implemented, there is no flaw in it. The government says it is in the “final stages”.

But both the court and the public are now tired of hearing “it will happen soon”.
