A PIL was filed in the Punjab and Haryana High Court which also surprised the judiciary. It was demanded in the petition that the fast of Karvachauth should be made mandatory for all women and it should be recognized as a collective ritual.
The bench of the High Court, which included Chief Justice Sheel Nagu and Justice Sumit Goyal, expressed displeasure over the petition. The court dismissed it as an impractical and irresponsible and also imposed a fine of Rs 1,000 on the petitioner. This amount is P.G.I. Poor patients will be deposited in the welfare fund.
What was the demand in the petition?
The petitioner claimed that the tradition of Karvachauth is not clear and it should be made mandatory for all women. The following demands were made in the petition:
- The fast of Karvachauth should be mandatory for all women.
- Widows, divorced, separate women and women living in live-in relationship should also be allowed to participate in it.
- Karvachauth Vrat should be declared as Maa Gaura Utsav or Maa Parvati festival.
- There should be a provision for punitive action against women who refuse to observe Karvachauth fast.
Court response
The High Court described the demands of the petitioner against the impractical and the fundamental rights of the Constitution. The court said:
“This case comes under the privilege of the assembly. The judiciary cannot intervene on this. “
The bench said that the petition ignores that women have different social and personal circumstances.
- It is unconstitutional to force widow, divorced, or women who live separately into such traditions.
- Karvachauth is a matter of personal and traditional belief, which is not compulsory.
Order of fine
The court dismissed the petition and imposed a fine of Rs 1,000 on the petitioner. This amount is P.G.I. It was ordered to be deposited in the poor patient welfare fund. The request to withdraw the petition by the petitioner’s counsel was also rejected.
