A big and historic decision of the Supreme Court has come out regarding the process of Special Intensive Revision i.e. SIR in the country. The apex court has declared this process completely constitutional and legal. However, this decision of the court has caused great disappointment to the social workers and opposition leaders who filed the petition. Yogendra Yadav, who was a petitioner in this case along with prominent personalities like Association for Democratic Reforms (ADR), Mahua Moitra, Manoj Jha, KC Venugopal and Supriya Sule, has also expressed deep disappointment over this stand of the court.
But a new twist came in this whole matter when senior journalist Swati Chaturvedi sharply retaliated on this disappointment of Yogendra Yadav. He directly attacked Yogendra Yadav on the social media platform X and raised questions on his stand in the court.
“You look like a wounded and defeated person, Mr. Yadav.”
Swati Chaturvedi used very strong words while reposting Yogendra Yadav’s post on X. they wrote:
“Sorry Mr. Yadav, you look like a wounded man. If you had no faith in the judiciary of the country, then you should not have become the appellant in this case. Now that the decision of the highest court of the country has come, you are creating such a ruckus. Please, stop it now.”
Swati Chaturvedi further said that we all are responsible citizens of India. Through such statements, an attempt is being made to reduce the confidence of the common people in Indian democracy, which will not do any good to anyone. Questioning the style of Yogendra Yadav, he said that he does not understand why you always have a problem with everything, and why you are seen acting like a ‘suicidal signal’ for the opposition.
What did Yogendra Yadav say that created an uproar?
After the Supreme Court’s decision, Yogendra Yadav had shared a long note explaining the reason for not going to the court. He believed that the outcome of this case had been decided long ago, hence there was no curiosity or restlessness in his mind regarding the decision.
Main allegations and arguments of Yogendra Yadav:
-
The direction was decided in August itself: According to Yogendra Yadav, the direction of this entire matter was decided in August last year itself. After hearing the arguments for three days, the Court, instead of examining constitutional principles, started treating itself as a ‘consumer forum’, where the emphasis was only on grievance redressal and arbitration.
-
Shortcomings of Bihar elections and voter list: He alleged that the court had taken the actual decision at the same time when the Election Commission (ECI) was allowed to conduct Bihar elections in a hurry without deciding any main policy. The court did not even ask the Election Commission to remove the major deficiencies in the new voter list prepared after the SIR.
-
Questions raised on court comments: Yogendra Yadav said that when the judges in the court openly commented that no one would be allowed to obstruct the SIR process, then only the lingering doubts were put to rest. He termed the comment of a judge as the last nail in the coffin of the petition which said that people whose names have been struck off from the voter list can vote in the next elections.
‘Lakhs of citizens deprived of voting rights’
Ignoring the legal complications, Yogendra Yadav finally made a big claim. He said that the simple and bitter truth is that the highest court of our constitutional democracy has already given approval to deprive lakhs of citizens of their biggest right i.e. voting rights. According to him, till now at least 5.9 crore (59 million) people of the country have been affected by this entire process and this figure may reach 10 crore (100 million) in the coming time. Due to this frustration, he had raised questions on the court’s decision, which has now sparked a heated debate in journalism and political circles.
