
Prayagraj: Allahabad High Court said that along with misuse of criminal laws, the rate of unsuccessful relationships is also increasing. High Court Judge Krishna Pahal made this comment, accepting the bail plea of 42 -year -old Arun Kumar Mishra. The 25 -year -old woman has accused 42 -year -old married Arun of rape.
The High Court said that the complainant knew that the accused had been married three times. Nevertheless, he formed a relationship with him. This matter is a sign of changes in society, in which there has been heavy erosion of the sanctity and severity of personal relationships. When such relationships begin to deteriorate, criminal laws are misused. Considering all the facts, the arguments of both sides and the eligibility of the woman, the High Court granted bail to the accused.
The High Court also said that the FIR was recorded after a delay of six months, which seems to be a symbol of the emotional consequences of a failed relationship rather than a criminal offense. In the bail plea, the accused party has claimed that the relationship between the two was formed by consensus. The two traveled together and even stayed in hotels together, while the prosecution claims that the accused is a person who seals women and makes a relationship with them. In this case, a 25 -year -old woman lodged a rape complaint against a 42 -year -old man, after which the accused was arrested last year. The girl claims that she made a video of her relationship with me and later started blackmailing me. The High Court said that the victim knew that the accused was married, and prima facie it seems that a complaint was filed in emotional impulses after the relationship broke.
