The Supreme Court has canceled the life sentence of a convict in the case and has now directed his case to be handed over to the Juvenile Justice Board (Juvenile Justice Board). This decision is based on the fact that the guilty was a minor at the time of crime. The whole matter is about 36 years old. In 1988, there was a kidnapping and gang rape incident, on which the person was sentenced. During this long legal battle, the convict repeatedly argued that the time the crime took place was a minor. A medical board was formed to confirm the claim, which after investigation, estimated that his age was 17 years, 11 months and 14 days at the time of crime. This age comes under the category of “minor” according to the definition of the Juvenile Justice (Care and Protection of Children) Act, 2000, as it is less than 18 years. A bench of Gawai and Justice Sandeep Mehta gave this verdict. He clarified that since the person was a minor at the time of crime, the life sentence against him as an adult will not be valid. The court said that the provisions of Juvenile Justice Act, 2000 apply in such cases. Now this case will be sent to the Juvenile Justice Board. The board will investigate whether the guilty can be rectified and brought back to the mainstream of the society, or attempts to rehabilitate him in any other proper manner. Currently, this person is 52 years old. This decision is legally important, as it shows how seriously the person takes the age of the person at the time of crime and how it should be evaluated under adolescent justice laws. This does not fully acquire the guilty, rather it ensures that his case is seen under the right legal scope and proper rehabilitation principles, as the Juvenile Justice Act. This law considers adolescent criminals separate from adult criminals so that they have the opportunity to improve.
