Rahul Gandhi: The Allahabad High Court has given a major blow to Rahul Gandhi. The Lucknow bench of the Allahabad High Court has refused to give any relief to the Leader of the Opposition Rahul Gandhi in the Lok Sabha in the alleged derogatory remarks against Vinayak Damodar Savarkar.
There is no need for court intervention.
The court dismissed the petition, saying, “Rahul Gandhi has an option to file a review petition against his summons in the Sessions Court, so there is no need for court intervention at this time.”
The lower court order was challenged.
This order was given by the single bench of Justice Subhash Vidyarthi. The petition challenged the lower court order to summon Rahul Gandhi in the case of alleged derogatory remarks against Savarkar. Along with this, Rahul Gandhi also challenged the ongoing proceedings against him in this case.
His lawyer Pranshu Aggarwal argued that the allegations made in the complaint do not make a case under sections 153A and 505 of the IPC, yet the lower court has summoned the petitioner under these sections.
Option to file a reconsideration petition with the petitioner: Allahabad High Court
It was also said that the lower court has issued summons to Rahul Gandhi, ignoring the provisions of Section 196 of the Criminal Procedure Code. However, the court said without commenting on the merits of the case, that the petitioner had an option to file a review petition.
