The court said that on one hand the government is forming committees to reduce litigation, while on the other hand it is increasing the burden of the court by appealing in small cases.
This whole matter is related to a fourth class employee (driver) Vijay Kumar Ram, to harass whom the government reached the double bench of the High Court, but it had to face defeat there too.
What was this whole matter?
Actually, Vijay Kumar Ram, who worked as a driver in Ranchi Civil Court, did not get promotion on time. Regarding this matter, he went to the single bench of the High Court, where the court considered his arguments correct and ruled in his favor and directed the concerned department to promote him.
But, instead of accepting this decision of the single bench, the government challenged it in the double bench of the High Court. Hearing this appeal of the government, the division bench headed by Justice Anand Sen found that the government was unnecessarily prolonging the matter.
The court issued a strong rebuke
Justice Anand Sen made sharp remarks during the hearing on the working style of state government officials. He said that it is a very strange situation that on one hand the government is forming committees to reduce the burden of unnecessary cases, while on the other hand its officers are filing appeals in such cases against small employees.
The court clearly said that such unnecessary appeals not only waste the precious time of the court but also put a burden on the government treasury, which is public money. The court held that this case was not worth appealing.
Government will have to pay damages
The court rejected the appeal of the state government and imposed a fine of Rs 20,000. The government will have to give this amount to the employee Vijay Kumar Ram, who had to suffer mentally and financially due to this unnecessary litigation. This decision of the High Court is a strong message to those officers who misuse government resources by creating ego battles in small matters.
