25 thousand rupees fine on JDA for not giving possession of the plot

Jaipur, 27 April (HS). District Consumer Commission, Jaipur-I has termed not handing over the possession of the residential plot selected in the lottery of Amrit Kunj Yojana to the allottee even after 14 years, as a serious deficiency in service. The Commission imposed a compensation of Rs 25,000 on JDA for not handing over the possession of the plot and said that due to the service default of the opposition, the complainant has been deprived of the use of his huge deposit amount. In such a situation, JDA should return the deposited amount of Rs 9,87,800 with 6 percent interest from June 16, 2021. Commission Chairman Subesingh Yadav and member Neelam Sharma gave this order on the complaint of Manphool Bairwa.

It was said in the complaint that in the year 2010, JDA invited applications for allotment of plot in the housing scheme Amrit Kunj on Kalwad Road. In this, the complainant also applied and on September 8, 2010, he was allotted a plot of 225 square meters through lottery. He deposited Rs 25,000 and the allotment letter was also issued to him on 22 March. He deposited Rs 9,36,700 on April 4, 2013, but due to a legal dispute, JDA canceled this plot and in 2019 allotted him a new plot of 25 square meters less area than the existing plot, but did not give him the possession of this plot either. Challenged this in the consumer court and requested JDA to return the deposited amount along with damages and expenses. JDA replied that there was a legal dispute over the housing scheme and it had no control over it. Now preparations are being made for allotment to the complainant in Amrit Kunj II Scheme. After hearing both the parties, the Commission gave its decision in favor of the complainant, imposed a compensation of Rs 25,000 on JDA and ordered it to return the deposited amount along with interest.
