What does UAPA mean?
The full name of UAPA is – Unlawful Activities (Prevention) Acti.e Unlawful Activities (Prevention) ActAs the name suggests, this law has been made to prevent illegal activities in the country, especially terrorism. You can consider this as the biggest and strongest weapon of the government against terrorism. This law was made in 1967, but with time, keeping in mind the changing face of terrorism, changes were made in it several times, due to which it became more stringent.
Why is this the most dangerous law in the country? 5 things that make it tough
This is not like normal laws. In this, the investigating agencies get some such powers, which make it very dangerous:
- Now not only organizations, any individual can also be declared a ‘terrorist’: After the biggest change in 2019, now the government can declare not only any group but also an individual as a terrorist. This can be done without any doubt.
- Almost impossible to get bail: If someone is arrested under this law, it becomes very difficult for him to get bail. As long as the case continues, the accused often has to remain in jail.
- Police gets long time: In normal cases, the police has to file a charge sheet within 90 days, but under UAPA, the investigating agency gets 180 days, i.e. about 6 months.
- NIA gets super power: This law gives a lot of power to the NIA (National Investigation Agency). She can go to any state and conduct raids and investigations without the permission of the police there.
- Punishment? From life imprisonment to hanging: If found guilty under UAPA, there is a provision for very harsh punishment, which can include life imprisonment and in some cases even death.
In short, UAPA is a very important law to maintain the security and integrity of the country, but due to its strict provisions it always remains in discussion.
