Jharkhand High Court’s big decision: stay on order to cancel more than 20 recruitment examinations of JPSC and JSSC


A very big and relief news has come out for the youth and already selected employees preparing for competitive examinations in Jharkhand. Jharkhand High Court has stayed the decision of the state government, under which various examinations of Jharkhand Public Service Commission (JPSC) and Jharkhand Staff Selection Commission (JSSC) were cancelled. This important decision of the court has brought great relief to thousands of candidates who had passed the examination after hard work and got a government job and were now deeply worried about their future.

Reference to natural justice and arguments of the petitioners

In the petitions filed in the court, it was mainly argued that the state government unilaterally canceled the entire recruitment process and appointments without giving any opportunity of personal hearing and without assigning any clear reason. Citing ‘Principles of Natural Justice’, the petitioners said that if the role of a particular candidate is found suspicious during the investigation, then action should be taken only against him.

But, it is completely unfair to exclude all the successful candidates from service together without any individual scrutiny or hearing. The candidates said that they had given the examinations with complete honesty and following the prescribed selection process, had made their place in the merit list and were then legally appointed to government posts.

JSSC-CGL exam and CID investigation case

This whole controversy started when the Jharkhand government had taken a big decision to cancel 22 recruitment examinations simultaneously, based on the findings of the investigation by CID and SIT regarding alleged irregularities in various competitive examinations.

Further, in the JSSC-CGL case also, the petitioners had drawn the attention of the Court to the fact that the results of the examination had already been declared in full compliance with the earlier orders of the High Court. In such a situation, serious questions arise on the legal validity of the government’s decision to suddenly cancel the entire examination. Now after this latest and strict order of the High Court, all those successful candidates who were confused about their appointments have got a big legal relief.
