Once again a tough stance of the administrative system is going to be seen in Bihar. This time the state government has taken a big and tough decision to completely bulldoze the illegal encroachment along the National Highway. After this new order of the government, in the coming days, bulldozers will be seen roaring to demolish illegal constructions along all the national highways of Bihar.
Under this new government decision, unauthorized dhabas, hotels, shops and all other types of commercial structures running without permission in the ‘Right of Way’ area of the National Highway will be completely razed to the ground. Taking a strict stand in this regard, Bihar Chief Secretary Pratyaya Amrit has given an ultimatum of just 20 days to voluntarily remove all illegal constructions.
20 days extension: If illegal construction is not removed within stipulated time, task force will take action
According to the guidelines issued by the Chief Secretary, if the encroachers themselves do not remove their illegal structures within the prescribed period of 20 days, the ‘District Highway Safety Task Force’ constituted under the chairmanship of the District Magistrates (DM) of the respective districts will come into action mode. This special task force, along with heavy police force and bulldozers, will forcefully remove all these illegal hotels, dhabas and shops.
Along with this, the government has completely banned any kind of new dhaba, hotel or commercial construction in the ‘right of way’ area of the National Highway with immediate effect. Now, if any person wants to do new construction on the highway side, it will be mandatory for him to obtain a duly approved No Objection Certificate (NOC) from the concerned technical departments like NHAI, NH Wing or Road Construction Department (RCD) before starting the work. This tough decision has been taken in the high level meeting of ‘Bihar Road Safety Council’ held on Wednesday under the chairmanship of Chief Secretary Pratyaya Amrit.
Compliance with Supreme Court order: These two accidents of 2025 shook the country
There are strict instructions from the Supreme Court behind this mega action being suddenly launched by the Bihar government. In fact, in November 2025, two very serious road accidents took place in Phalodi of Rajasthan and Rangareddy district of Telangana due to illegal encroachment on national highways and parking of unauthorized vehicles parked on the national highway. A total of 34 innocent people died untimely in these two tragic accidents.
Taking suo motu cognizance of these accidents, the Supreme Court had issued strict orders to make the highways of all the states of the country safe and encroachment free. Bihar government is going to run this mega campaign to ensure complete compliance of this court order. All top officials of Transport Department, Road Construction, NHAI, Union Ministry of Road Transport and Highways, Urban Development and Housing Department and Police Headquarters were present in this important meeting.
Complete ban on illegal parking: Heavy fine will be imposed for violation
It was also made clear in the meeting of Bihar Road Safety Council that not only illegal constructions will be removed on National Highways, but a comprehensive and continuous checking campaign will be started across the state regarding illegal parking. Bihar Government has completely banned unauthorized parking of heavy trucks, buses and other commercial vehicles in the ‘Right of Way’ area of the National Highway.
Now no driver will be able to park his vehicle unattended on the main road or side of the highway. Only authorized places (like lay-by or truck terminus) designated by the Government and NHAI can be used for parking of vehicles. Along with imposing heavy fines, strict punitive and legal action will be taken against the drivers and vehicle owners who make fun of the rules.
New guidelines for hotels and commercial establishments: You will have to make your own alternative route
The government has also issued new guidelines for legal hotels and commercial establishments already built along the highway. The Road Construction Department has clarified that dhabas, hotels or petrol pumps whose entry is directly connected to the National Highway will now mandatorily have to construct an alternative approach road at their own expense. They will have to make separate safe entry and exit arrangements for the movement of their customers’ vehicles so that the traffic on the main highway is not affected. Strict legal action will be taken against the establishments that do not do so under the ‘Control of National Highways Act 2002’.
Additionally, it has also been made strictly mandatory for all structures located outside the ‘Right of Way’ area of National Highways but within the ‘Highway Safety Zone’ (which is set at 40 meters for residential areas and 75 meters for commercial areas) to obtain due NOC from the concerned department.
