New Delhi, August 7 (HS). The Supreme Court has directed to remove the comments in an order issued by the Punjab and Haryana High Court, which criticized the Supreme Court.
On Wednesday, the Constitution Bench headed by Chief Justice DY Chandrachud said that we are hurt by the comments made by the High Court. These comments are not only unnecessary but also lower the dignity of the Supreme Court as well as the High Court. A party may be dissatisfied with the court's decision, but judges can never express dissatisfaction over an order passed by a higher constitutional forum than themselves.
In fact, Justice Rajbir Sehrawat of the Punjab and Haryana High Court, in an order dated July 17, had criticized the Supreme Court for stopping the contempt proceedings initiated by the High Court. The Constitution Bench headed by the Chief Justice took suo motu cognizance of the High Court order and heard it. The Supreme Court refrained from taking any further action in this matter and expressed hope that in the coming days, the judges will take necessary caution while talking about the order of the Supreme Court or the Division Bench of the High Court.
During the hearing, after this order of July 17, a viral video of Justice Sahrawat's hearing in another case was also mentioned. In this video, he had called the order of the division bench nonsense and questioned the order of the Supreme Court. The Chief Justice said that in this era of live streaming of hearings, judges should take necessary precautions during hearings and avoid making such comments that harm the judicial process.
