
Bilaspur , Petition for ‘virginity test of wife’ in bilaspur high court:The Chhattisgarh High Court, while giving a verdict in a very sensitive and important case, not only described the wife’s demand for virginity testing by the husband, but also termed it against the dignity of the woman and her fundamental rights. This decision has once again highlighted the issue of women’s rights and their privacy.
A bench headed by Justice Arvind Kumar Verma made it clear that any test that hurts the privacy, dignity and self -esteem of the woman, is a direct violation of Article 21 – that is, life and personal freedom – is a direct violation of the Constitution. The court said in strict words that such allegations and demands on women are not only inhuman, but also contrary to the values of a civilized society.
What was the whole matter?
The dispute is associated with Raigad district, where in July 2024, a woman filed a petition in the family court demanding ₹ 20,000 per month maintenance from her husband. The two were married on 30 April 2023 according to Hindu customs. But after a few months of marriage, tension arose in the relationship between the two.
The wife alleged that her husband is impotent and could not perform in marital life. At the same time, the husband retaliated and accused the wife of having an illicit relationship with her brother -in -law and claimed that she was not a virgin at the time of marriage. On this basis, he demanded the virginity test of the wife to “bring out the truth.”
The family court had rejected this strange demand, but the husband filed an appeal against it in the High Court.
Strict court comment
The Chhattisgarh High Court took the matter very seriously and said in clear terms that virginity test not only hurts a woman, but it is also a reflection of rooted patriarchal thinking. The court commented:
“If the husband wants to prove his impotence allegation false, he can voluntarily conduct his own medical examination, but he cannot impose such an inappropriate, unconstitutional and illegal demand on his wife.”
This statement is not only from a legal point of view, but also from social and moral point of view. The court also clarified that demanding an inquiry into a woman’s virginity after marriage is a serious right violation and it hurts her dignity.
