The matter was before the bench headed by the Chief Justice. A petitioner named Arun Kumar Dubey had filed the Public Interest Litigation (PIL). He said that so many years have passed, governments have come and gone, but no one has finalized the rules of the PESA Act. Panchayat elections are being conducted without PESA law, which is unfair to the tribal society.
Hearing this, the court has asked the government to leave aside ‘paper matters’ and give concrete answers. The court asked whether any draft is ready? And if so, why is it taking so much time to get off the ground?
What does the government say?
On behalf of the government, the Advocate General tried to reassure the court. He said, “My Lord, the draft is absolutely ready. It just needs to be approved by the Cabinet and made public for public comments. This process will be completed soon.”
However, the court did not rely on mere words and directed the government to file an affidavit stating what would be the final date.
