Rejecting the petition, High Court Justice Vivek Aggarwal has said in his order that EWS reservation is implemented on the basis of seats earmarked for the unreserved category. It is noteworthy that a petition was filed in the High Court against not giving ten percent reservation to the EWS category on the basis of the number of posts. It was said in the petition that 10 percent reservation of all the posts of lab technicians that have been filled should be done in the form of EWS seats. The special advocate appointed by the government argued in the court against the petition and said that the General Administration Department has issued rosters in other recruitments by misinterpreting Articles 16(6) and 15(6) of the Constitution, whereas the Constitution The formula for implementing 10 percent EWS reservation should be on the scale of the remaining unreserved seats.
While hearing the petition, the single bench found that out of the prescribed posts, 122 posts were for OBC, 46 posts were for ST and 13 posts were for ST category. 34 posts were earmarked for general category. The single bench said in its order that EWS reservation is prescribed only for the general category. Ten percent reservation has been provided to the EWS category as per the numbers prescribed for the general category. The single bench dismissed the petition with the said order. After the important and big decision of the High Court, now questions can be raised on the recruitments done on the basis of wrong roster in different departments of Madhya Pradesh. With the order of the High Court, all those petitions have been rejected in which 10 percent EWS reservation was challenged as compared to the unreserved category.
