Article 370 Review Petition: The Supreme Court has agreed to review a review petition challenging the Supreme Court's decision upholding the Central government's 2019 decision to abrogate Article 370. The court will consider all the applications on May 1. Let us tell you that in December last year, the Supreme Court had considered the removal of Article 370 from Jammu and Kashmir as constitutionally valid.
Chief Justice (CJI) DY Chandrachud in his judgment upheld the Centre's decision to remove Article 370, saying it was a temporary provision and the President had full authority to remove it. While giving this decision, the Supreme Court rejected all the petitions filed against the removal of Article 370.
Article 370 was abolished in the year 2019
Taking a historic decision, the Government of India abolished the disputed Article 370 from the country in the year 2019. It started with King Hari Singh of Kashmir. In October 1947, the then Maharaja of Kashmir Hari Singh signed an instrument of accession stating that Jammu and Kashmir would transfer its authority to the Government of India over three subjects namely foreign affairs, defense and communications. In July 1949, Sheikh Abdullah and three other associates joined the Indian Constituent Assembly and negotiated special status for Jammu and Kashmir, resulting in the adoption of Article 370. The controversial provision was drafted by Sheikh Abdullah.
