Government job will not be stuck waiting for character verification

29 October, Lucknow. After being selected for a government job, now the youth will not have to wait for the appointment till the character verification report comes. The state government has issued a new integrated policy of character and antecedent verification to make the appointment process simple and time bound. Under this, the selected candidates will be given appointment letters with conditions even if the police verification process is ongoing. The appointment will be confirmed once the verification report is found correct. The police and concerned authorities will have to provide the verification report within 30 days. This will remove unnecessary delays in the appointment process and will provide relief to the candidates from repeatedly visiting police and administrative offices.

Chief Minister Yogi Adityanath’s government has set unified guidelines in place of the government orders issued till now regarding the process of character verification before the first appointment of selected candidates in various departments. In the government order issued by Principal Secretary M. Devraj, it has been made clear that the process of issuing appointment letters will not be stopped merely because the verification report is pending. The appointing authority will issue the appointment letter after obtaining the prescribed verification form and self-declaration form from the candidate. However, appointments to security sensitive posts will be made only after detailed verification is completed. In such special cases, prior approval of the Chief Minister will have to be taken as per the prescribed procedure.

Police will not be called, verification will be done from records
In the new policy, special attention has been given to the convenience of the candidates. Under normal circumstances, the police or local intelligence unit will not go to the candidate’s house and inquire for character verification. He will not even be called to appear in person. There will be no need to ask for additional documents. The police will investigate and submit a report on the basis of available records. In special circumstances, on the request of the appointing authority, the District Magistrate will be able to conduct an investigation on the spot.

For verification, the report will have to be provided to the Director General of Police (Information) and the District Magistrate within 30 days of receiving the reference. If the report is not received within the stipulated period, the appointing authority will send the matter to the Home Department. The Home Department will ensure necessary action to provide the report.

Appointment will not stop just because case is registered
The government has also clarified the rules related to criminal cases. Mere registration of FIR, pending investigation or filing of charge sheet will not automatically disqualify the candidate. His eligibility will be decided depending on the nature of the crime and the status of the case in the court. In certain specified categories of serious offences, disqualification will apply upon arraignment or conviction by a court, while in other categories conviction will be required.

Provisions have also been made for relief in cases of final acquittal by the court, settlement of the case by settlement as per law and some minor offences. However, the candidate will have to give correct information about the cases registered against him. There is a provision for cancellation of appointment and legal action for deliberate concealment of facts or making false declaration.

You will get a chance to present your side even on adverse reports
Even if the report of the police or local intelligence unit is adverse against a candidate, he will be given an opportunity to present his side. The District Magistrate will hear the concerned candidate before sending his report to the appointing authority. This hearing can also be held online.

There will be no re-character verification of employees already working in government service. If necessary, information can be obtained from their former department. Information will also be taken from the police of the concerned state regarding candidates who have lived outside Uttar Pradesh for one year or more in the last five years.

The new policy will be applicable to appointments made through direct recruitment in government departments as well as corporations, councils, educational institutions, autonomous bodies, undertakings and local bodies. Disposal of already pending cases will also be done as per the new guidelines.
