Historic decision of Yogi government regarding UP Panchayat elections

Amidst the murmur of three-tier Panchayat elections in Uttar Pradesh, the Yogi Adityanath cabinet has taken a very important and tough decision. The state government has formally approved the proposal of ‘Uttar Pradesh Panchayat Raj (General Residence Concept) Rules, 2026’ to bring transparency in the process of preparing voter list for Panchayat elections and to curb fraud. After the implementation of this new amendment, now to include his name in the voter list of any rural area or Gram Panchayat, it will be mandatory for the person concerned to reside in that village continuously for at least six months. This step of the government is expected to effectively curb the local level irregularities during elections and the tendency of registering names at two different places.

What is the new rule and how will the definition of ‘ordinary residence’ be decided?

Till now, the terminology ‘ordinary resident’ or ‘ordinarily resident’ was used under sub-section (3) of Section 9 of the Uttar Pradesh Panchayat Raj Act, 1947, but no specific time period or clear criteria were fixed for it. Due to this lack of clarity, administrative officials and the Election Commission often had to face local disputes during voter registration. In many cases, people would get their names registered in the voter list for political or electoral gains without being a permanent resident.

In compliance with the instructions of Allahabad High Court and previous court orders, the state government has completely ended this confusion. Under the new rules, it has now been made clear that any citizen will be considered a valid voter of that Gram Panchayat only if he has been normally residing within the limits of that village for a minimum of six months or more. For its verification, the voter will have to present strong documents related to his residence like Aadhar card, electricity bill or other authentic identity card.

The game of registering names in voter lists of two different places will end.

The biggest advantage of this new change will be that now no person will be able to get his name included in the voter list of two different Gram Panchayats or places at the same time. If a citizen has come from another village or place and settled in a new area and wants to get his name added in the voter list of Panchayat elections, then he will compulsorily have to get his name deleted from the voter list of his old place of residence.

Administrative experts believe that strict adherence to this rule will automatically stop illegal activities like voting by the same person at two places or polarization of votes. Along with this, the district administration and election officials will also now have a clear legal basis in resolving the objections during the revision of the voter list, which will make the electoral process more fair and transparent.

High Court’s instructions and preparations for the upcoming Panchayat elections

It is noteworthy that recently the deadline and guidelines were fixed by the High Court regarding the three-tier Panchayat elections in Uttar Pradesh. In view of the instructions of the court, the State Government and the Election Commission are busy finalizing all the necessary administrative preparations for conducting Panchayat elections. Accuracy of voter list is the first and strongest step of any democratic election.

This visionary decision of Yogi Cabinet will not only drastically reduce the number of fake cases and election disputes at the local level, but will also strengthen the credibility of Gram Panchayat elections. It has now become mandatory for the voters and prospective candidates of rural areas to get their residence certificates verified in time, so that they do not face any kind of technical or legal hindrance while voting or candidating in the upcoming Panchayat elections.
