New Delhi: The issue of extradition of former Bangladesh Prime Minister Sheikh Hasina has once again become heated. Chief Advisor to the Interim Government of Bangladesh Mohammad Yunus has met International Criminal Court (ICC) lawyer Karim AA Khan.
The conversation between the two focused on the process of prosecuting those accused of crimes against humanity.
What is the treaty between India and Bangladesh?
The biggest question is whether India can send Sheikh Hasina back to Bangladesh. The possibility of this is very less. However, India and Bangladesh have an extradition treaty since 2013. According to the extradition treaty, both the countries have to extradite criminals to each other.
In 2015, Bangladesh handed over Anup Chetia to India. Anoop Chetia was the leader of the separatist organization ULFA of Assam. He was imprisoned in Dhaka jail in 1997.
Can the treaty be broken?
The treaty provides that a person may be extradited if he has committed an offense punishable with imprisonment for not less than one year.
It is noteworthy that Article 21(3) of this treaty between the two countries allows both the countries to terminate this treaty. It is possible that India may break this treaty in case of Sheikh Hasina's extradition.
