Mamata Banerjee: The Calcutta High Court recently cancelled all OBC certificates issued in the state since 2010. Angered by the decision, West Bengal Chief Minister Mamata Banerjee on Friday announced that her government would challenge the High Court order.

Will go to Supreme Court after summer vacation

Addressing an election rally at Sagar in South 24 Parganas district, Banerjee said the state government will approach the Supreme Court after the summer vacations, she said. “We do not accept the order to cancel OBC certificates. We will go to the Supreme Court against the order after the summer vacations,” she said.

The Calcutta High Court on Wednesday revoked the OBC status given to several classes in West Bengal since 2010. This created a political controversy amid the Lok Sabha elections. The court said that including 77 categories of Muslims in the list of backward classes is like treating them like a vote bank. In her address at the election rally, Banerjee urged the voters that she would not give a single vote to the BJP or any other party except the Trinamool Congress.

Five lakh OBC certificates will become invalid

The court made it clear that the cancelled certificates cannot be used in any recruitment process from the date of this decision. This will render about five lakh OBC certificates invalid. However, the bench of Justice Taponatha Chakraborty and Justice Rajasekhar Mantha also said that the candidates who have already got a chance with these certificates will not be affected by this decision.

There was no mention of the Trinamool government in the decision

The bench did not mention the Trinamool government in the decision. Incidentally, Trinamool has been in power in the state since 2011. Therefore, the court's order will be effective only on OBC certificates issued in the Trinamool government. The High Court order came in the case in 2012. The bench said that all OBC certificates made after 2010 are not valid. The legislature has to decide who will be in the Other Backward Classes. The West Bengal Backward Classes Welfare Commission will decide the list of OBCs. The list should be sent to the legislature. Those whose names will get approval from the Legislative Assembly will be considered OBC in future.
