Marriage is considered very sacred in India. At the time of marriage, seven rounds are taken while vowing to stay together for life. But in today's time, you must have seen many marriages breaking up in just a few years. There are many reasons for the breakdown of marriage, one of which is extramarital affairs. If her husband has an affair with another woman, then the woman concerned has the full right to decide what to do in that situation. Because extramarital relations are considered unholy in the Indian marriage institution. Also, let us know in detail how the court can be approached against it.
IPC section 497 repealed
Last year, the Supreme Court had abolished Section 497 of the IPC. Under this section, having sexual relations with another person after marriage was considered a crime. But the court has clearly said that having a relationship with someone else after marriage is not a crime. Now the question is, if this is not a crime, should the husband and wife sit in this family? So no, absolutely not. If one spouse has a relationship with someone else, then the other spouse has the right to seek justice under the law.
3 years imprisonment
Daljeet Kaur filed an FIR against her husband Nikhil Patel under sections 85 and 316 (2) of the Indian Penal Code.
Under Section 85 of the Act, ill-treating the husband or any member of his family can result in imprisonment of up to 3 years.
