How many years of jail can one get for slapping?
Slapping someone is a legal offense. In such cases, a case is registered under Section 323 of the IPC. Under Section 323 of the IPC, if a person voluntarily hurts or damages someone, he can be jailed for one year for doing so. Also fined Rs. 1,000 fine or both, but if a person misbehaves and slaps the defendant, the court can modify the sentence or even dismiss the case. If a person uses criminal force or symbolic attack to intimidate another person, which does not cause any harm but the victim is scared, he will still be held guilty under Section 358 of the IPC.
What happened before?
Earlier, the police used to take preventive action on such incidents under section 107/51 of CrPC. Under this, the accused was presented before the duty magistrate, where he was released on the spot after warning him to be of good conduct for one year.
