New Delhi: The rape and murder of a female trainee doctor at Kolkata's RG Kar Medical College and Hospital has sparked outrage and protests across the country. There are also suspicions of gang rape of the trainee doctor. However, in the status report submitted to the Supreme Court on Thursday, the CBI has denied the possibility of gang rape of the trainee doctor. Also, the CBI has claimed that the crime scene has been tampered with and the attitude of the hospital system is suspicious. At the same time, the Supreme Court reprimanded the police for the 14-hour delay in filing an FIR for this incident.
After the rape and murder of a female trainee doctor in Kolkata sparked outrage across the country, the Supreme Court took suo motu cognizance of the incident and directed the CBI to submit a status report on Thursday. The CBI presented its report today before a bench headed by Chief Justice Dhananjay Chandrachud. Many revelations were made in this report.
The CBI said that its investigation so far has revealed that Sanjay Roy raped the victim and then killed her. That is, he is involved in the rape and murder. The DNA results also confirm Sanjay Roy's involvement. That is, the news of gang rape of the trainee female doctor is false. However, the CBI has said that it still has to complete its investigation on the theory of gang rape and involvement of other people.
The CBI has also said that the behavior of the hospital administration, including former principal Sandeep Ghosh, is highly suspicious. Evidence of tampering has been found at the crime scene. The CBI believes that despite knowing all the protocols, the hospital authorities, especially former principal Sandeep Ghosh, completely failed to secure the crime scene. Sandeep Ghosh did not show any promptness even after receiving information about the murder.
Meanwhile, after reading the CBI report in the Supreme Court, Chief Justice Chandrachud and the judges JB Pardiwala and Manoj Mishra in the bench reprimanded the Kolkata Police. Solicitor General Tushar Mehta, on behalf of the CBI, said that the videography of the incident site was done after pressure from the hospital doctors and the victim's friends. That is, they were afraid of getting trapped in this case. Apart from this, the victim's father lodged an FIR. The hospital did not register an FIR in this incident. The CBI started the investigation five days after the incident. By that time the crime scene had been tampered with. He said that the first FIR was registered at 11.45 pm after the victim's cremation. Initially, the hospital officials told the parents that it was a suicide and then an unnatural death. The Supreme Court reprimanded the police and hospital system for delaying the victim's postmortem for a delay of 14 hours in filing the FIR. The bench asked Kapil Sibal, the lawyer appearing on behalf of the West Bengal government, when did the postmortem take place? Sibal said between 6.10 pm and 7.10 pm. After this, the bench raised the question that the rape-murder of the trainee doctor happened on the night of 8-9 August, but the police was informed about it at around 10.10 am on 9 August. What was the hospital system doing all this time?
Justice Pardiwala said, “This is not the procedure followed by the police in criminal law, as prescribed in the CrPC or as I have seen in my 30-year career. The conduct of the Assistant Superintendent of Police is suspicious. The bench said that apart from this, if the police registered an unnatural death at 11.30 pm, then how was the post-mortem done before that? Along with this, the bench asked the Kolkata Police officer who registered the first entry in the case to submit the time of entry in the police diary and a detailed status report. With this, the bench adjourned the next hearing till September 5. Meanwhile, a lawyer raised the issue of 150 grams of semen in the post-mortem report. On this, Chief Justice Chandrachud immediately criticized him and asked him not to argue on the basis of social media. He said that we have the actual PM report and we also know how much 150 grams is.
