‘This much freedom of expression is also not good..’ Another statement of former CJI Chandrachud in discussion

DY Chandrachud on freedom of expression: Former Chief Justice of India (CJI) DY Chandrachud on Friday expressed concern over the possible threat to freedom of expression. Chandrachud said that if it is launched without any restrictions, it could give an opportunity to those with more resources and power in the society to suppress the voices of other weaker sections. Delivering a speech in the Kerala High Court on the topic ‘Fraternity under the Constitution – the quest for an inclusive society’, Chandrachud said that in an unequal society the powerful can use their freedom to work against the weaker sections.

Unrestricted freedom of expression can increase hatred in society: Chandrachud

Chandrachud said, ‘In an unequal society those who have power will use their freedom to promote activities that are harmful to the weaker sections. If expression is completely free then those with more resources and power can suppress the voices of others. While freedom of expression is a constitutional guarantee and aspiration, its unrestricted expression can promote hate sentiments in the society. These statements can disrupt the equality of society. Freedom of expression is a constitutional guarantee and aspiration, but if it becomes obnoxious then this very freedom will destroy equality.

Weaker section will be harmed: Chandrachud

Chandrachud further said, ‘If everyone in the society is treated equally without any difference and unequal distribution of resources is ignored, it will benefit those who have more resources and the weaker sections will be marginalised. ‘ Equality can destroy the freedom of the weaker sections. In a democracy, brotherhood is a very stable force, which works for everyone.
