Prayagraj, 23 February (HS). The Allahabad High Court has modified the death sentence given by the trial court in the case of rape and murder of a three-year-old girl and has sentenced her to thirty years of imprisonment.
The court said that the possibility of improvement in the petition cannot be ruled out. This order has been given by the division bench of Justice Ashwani Kumar Mishra and Justice Syed Aftab Hussain Rizvi while partially accepting the petition of Dinesh Paswan.
An FIR was registered against the petitioner at Khaga police station in Fatehpur district under various sections of the IPC and POCSO Act, including rape and murder. During the hearing, the trial court sentenced him to death. After the hearing, the court said that in view of the circumstances, the sentence of life imprisonment for the entire life of the petitioner should be modified to fixed term imprisonment for a period of 30 years without any remission or benefit. So that the main part of his life was spent in jail. The petitioner will be released from jail only after serving the entire sentence of 30 years, excluding the sentence already served.
