allahabad high court news : Allahabad High Court has made a big comment in the case of a woman who did not serve her in-laws. A bench of Justice Saumitra Dayal Singh and Justice Donadi Ramesh said on the divorce petition filed by a Moradabad police officer, 'If a woman does not serve her in-laws, it cannot be called cruelty. Such things are personal. The court cannot investigate the condition of all the houses in detail. This is not the job of the court.'

Not serving elderly parents is not cruelty

The petitioner argued that due to his employment in the police, he was always away from home. His wife did not fulfill her moral duty to serve her in-laws. To which the Allahabad High Court said, 'Such allegations are subjective. Not taking care of parents when the husband is away from home is not called cruelty. The level of supervision by the husband has never been established. There is no plea of ​​inhuman or cruel behavior by the husband to frame charges including divorce against the woman. If a woman fails to take care of her elderly mother-in-law when her husband is away from home, it can never be called cruelty.'

The High Court dismissed the petition

All disputes should be weighed fairly while determining cruelty. Earlier, the petitioner had filed a divorce petition in the Family Court of Moradabad on the basis of cruelty, but the court rejected the petition. After this, the petitioner filed a petition in the High Court against the decision of the Moradabad court. The petitioner was away from home due to work and he expected that the wife would stay with her parents. Taking cognizance of this matter, the court has rejected the petition, calling the petitioner's argument baseless.
