Supreme Court verdict on alimony: In recent times, there have been differences and quarrels on small things in marital life and have reached divorce. The relationship between husband and wife is “bond of seven births”, this saying has become meaningless today. There have been incidents of divorce on the same day of marriage in our country. Therefore, if divorce is taken by consent, then according to the law, the husband will have to pay so much alimony to the ex -wife.
There have been many incidents where some people have made a huge demand for alimony by making it capital. Now a woman has filed an application for divorce and has demanded Rs 12 crore as alimony from her husband, an expensive flat in Mumbai and a BMW car. Hearing the demand of this woman, Chief Justice of Supreme Court B.R. Gawai lashed out at him and slapped him and said, “Go to work and earn money.”
Yes, a woman who divorced after 18 months of marriage has made a special demand from her husband. Chief Justice of Supreme Court BR, who is hearing this case, Gawai said, “You are an IT professional, MBA. You worked in IT sector before marriage. You have decided not to work voluntarily after marriage.”
With your work experience, you can get a good salary job in Bangalore and Hyderabad. But are you asking for alimony? They asked. You can run your living with a living allowance of four crore rupees and a flat, which has agreed to give you. You are educated, so you should not beg. You should earn for yourself and live life, wisdom said.
The Chief Justice asked, “Your marriage has been only 18 months. Are you asking for so much maintenance?” He also questioned whether it is appropriate to expect this level maintenance despite being financially independent. The woman replied that her husband is rich and has filed a petition to cancel the marriage based on mental health problems (such as schizophrenia). Finally, the court gave the woman two options. Either take a flat without any legal trouble or take a total of 4 crore rupees as an agreement.
The Supreme Court, while giving a historic verdict in this case, has given a good message for working women seeking alimony after the society and after divorce. The court said that economically independent women should earn themselves instead of asking for a large amount of alimony from their husbands. The hearing of the case in the Supreme Court was very interesting. Surprised by the demands of the petitioner, the Chief Justice finally agreed to her wish and ordered the woman to work himself by working himself in addition to the alimony given by her husband.
