Mumbai: The court has rejected the bail plea of a Thane doctor arrested for allegedly raping a woman on the pretext of marriage. The court refused to grant bail to the 32-year-old Thane doctor, saying that he may tamper with the evidence as the case is under investigation.
Additional Sessions Judge Premlal Vithlani denied bail to the Thane doctor, saying that bail cannot be granted keeping in mind the investigation of the case and the gravity of the offence. The judge further said that each bail plea is decided keeping in view the details and circumstances of the case. There is no specific formula for accepting or rejecting a bail application.
The doctor and the 27-year-old woman became friends in 2017 and the doctor proposed to her in 2020. Earlier this year, the woman filed a police case accusing him of rape and threats. After the doctor's anticipatory bail plea was rejected on April 24, the police arrested the doctor on May 7.
The court considered evidence including mobile phone and audio recordings. Whether the accused is eligible for bail or not was to be decided keeping in mind the facts of the case. There is no doubt that the complainant has consented to physical relations. Several pictures were also produced. However, it was alleged that the accused obtained consent by threatening to expose private photographs and videos with a false promise of marriage. Such consent cannot be considered valid according to law.
