Jodhpur, 18 May (HS). Rajasthan High Court has put a stay on the suspension order of gynecologist doctor and has summoned the reply of the state government. The court has given the order while conducting preliminary hearing of the writ petition of Dr. Shailendra Lomrod. In this, advocate Yashpal Khileri appeared on behalf of the senior doctor.
Advocate Yashpal Khileri and Vineeta filed a writ petition on behalf of Dr. Shailendra Lomrod, a senior gynecologist working in JLN District Hospital under the Government Medical College of Nagaur, saying that he has been serving on the post of Medical Officer for the last 14 years and on the night of 10 May 2024. Due to being on night-off and on call duty, he was suspended by the in-charge of the hospital only because the mother died during treatment. In fact, at the time of the patient's death, he was neither on duty nor was called to the hospital as per the rules. Whereas CMO/Casualty Medical Officer and other doctors were also present on night duty.
It was stated on behalf of the petitioner that as per the rules, Medical Officers are State Service officers who are appointed by the State Government/Secretary, Medical Department and after giving an opportunity of being heard in the preliminary inquiry, only the Personnel Department can institute disciplinary proceedings if found prima facie guilty. But the Chief Medical Officer of the District Hospital has no authority and jurisdiction to suspend him and he has been suspended without any reason without waiting for the postmortem report and despite him not being on night duty.
While conducting the preliminary hearing of the case, the single bench of Justice Arun Monga stayed the suspension order of May 11 and summoned the response of the state government and others. Next hearing fixed for August 14, 2024.
