Supreme Court upheld the right to give bonus marks and relaxation in age limit, SLP rejected

Jaipur, 8 July (HS). The Supreme Court has upheld the provision of giving bonus marks and relaxation in age limit to the candidates who have worked in government educational projects on behalf of the state government in Prabodhak Recruitment-2008. At the same time, the order given by the High Court on May 21, 2010 in this regard has been upheld. The Supreme Court gave this order while rejecting the SLP of Mahesh Chand Bareth and others.

The Supreme Court said in its decision that the decision of the Rajasthan government to give bonus marks and age relaxation to teachers in government educational projects was appropriate and in such a situation there is no need to interfere in the order of the division bench. In the SLP, the decision of the division bench of Rajasthan High Court was challenged, in which the division bench had rejected the appeal by maintaining the order of the single bench dated January 7, 2009. The candidates had challenged the constitutional validity of Rajasthan Panchayati Raj Prabodhak Seva Rules 2008 and said that the state government cannot give the benefit of bonus marks and age relaxation to the candidates who have worked in government educational projects in the recruitment rules. Doing so is a violation of the right to equality of the Constitution. The state government has violated Articles 14 and 16 of the Constitution by giving the benefit of different bonus marks and age relaxation to teachers on the basis of employment in this recruitment. Therefore, this provision should be canceled.
