Supreme Court strictness on Prayagraj bulldozer action, warning to the state government

The Supreme Court has taken a tough stand on government bulldozer action in Prayagraj, Uttar Pradesh. The apex court has not only allowed the petitioners to re -build their homes, but has also given strict instructions to the state government. The court said that the administration’s forced demolition of the house was unfair and the affected people should be given the right to rebuild their homes.

What is the whole matter?

The petitioners told the Supreme Court that their houses were demolished by the administration as the property of gangster Atik Ahmed. However, he claimed that he was legally the owner of the land and the appropriate procedure was not followed in this action.

Atik Ahmed, who was a notorious criminal, was murdered in 2023. The administration broke several buildings while taking action on his illegal properties, but the petitioners say that their houses were not illegal.

Supreme Court order: Permission to re -build home

Justice Abhay S. A bench of Oka and Justice Ujjal Bhuiyan said during the hearing that the petitioners would be allowed to re -build the house at their expense. However, some conditions have been laid for this –

  1. Appeal will have to be filed before the Appellate Authority.

  2. If the appeal is rejected, the petitioners will also have to bear the expenses of re -demolishing the houses.

The court clearly said,
“We will pass an order that they can re -build the house at their expense, but if the appeal is rejected, they will have to drop it again at their own expense.”

Houses demolished in 24 hours: petitioners accused

After not getting relief in the Allahabad High Court, the petitioners approached the Supreme Court. He said that the administration issued a notice at midnight and the next day his houses were dropped, so that he did not get a chance to take any legal action.
