New Delhi, August 20 (HS). The Supreme Court has directed the CBI to file a status report by August 22 in the Kolkata rape and murder case. A bench headed by Chief Justice DY Chandrachud gave this order. The Supreme Court said that this is not just a case of murder in Kolkata, this is an issue of safety of doctors across the country.
The Chief Justice said that we are forming a National Task Force which will have doctors from different backgrounds who will suggest the methods to be adopted across India so that the working safety conditions are maintained and young doctors are safe in their working environment. We request the doctors to return to work and if patients lose their lives, we appeal to the doctors that we are here to ensure their safety.
The apex court said that in the Kolkata case, we are very concerned that the name of the victim and the photo, video of the deceased are being published in all the media. Her dead body was shown. Whereas the court says that the names of sexual victims cannot be published. During the hearing, senior advocate Kapil Sibal, appearing on behalf of the West Bengal government, said that this is a horrific incident. We have taken care of dignity. By the time the police arrived, photos and videos had been taken.
Then the Chief Justice said that the protocol should not be only on paper but it should be implemented in the whole country. The name and photo of the victim in Kolkata were published in all the media across the country. Sibal said that the investigation revealed that this is a murder case. Then the Chief Justice asked whether there is a mention of murder in the FIR. The Chief Justice said that the information about the crime was received in the morning. The principal of the hospital kept calling it a suicide. The victim's parents were not allowed to see the body. Then Sibal said that this is not right. Then the Chief Justice said that no FIR was registered till late night. What was the Kolkata Police doing? The victim's body was given to her parents in the evening for the last rites. The next day the doctors protested and a mob of some people entered the hospital and caused damage. After all, what was the Kolkata Police doing? A crime has happened inside the hospital. The police has to protect the crime scene. Sibal said that the accused is a civic volunteer. He was arrested by the police.
The Supreme Court objected to the behavior of the hospital principal and asked how this principal was immediately appointed as the principal of another college. The CBI should file a status report on this. The Chief Justice said that force should not be used on people protesting peacefully. The court said that there is a lack of institutional security in the medical profession. Despite working till late night, there is no rest arrangement for doctors. Despite working for 36 hours, there is not even a rest room for resident and non-resident doctors. There are no basic cleaning facilities. There is no transport arrangement for doctors to reach their homes. CCTVs do not work. There is no arrangement for adequate search of weapons.
It is noteworthy that on August 9, the body of a PG trainee doctor was found in the seminar hall of Kolkata's RG Kar Hospital. On August 10, a civil volunteer was arrested in this case. After this incident, the whole country was in uproar. Doctors started agitation across the country. On August 13, the Kolkata High Court ordered a CBI inquiry into this case. Recently, the Calcutta High Court reprimanded the West Bengal government for vandalism in RG Kar Hospital during the protest on August 14. Now the Supreme Court has taken suo motu cognizance of this matter.
