New Delhi: The Supreme Court has issued a notice to the Center and seven states demanding to implement the instructions given regarding the appointment of DGP and to make regular appointment for a fixed period of two years. The Supreme Court has issued notice to the Central Government including Uttar Pradesh, Uttarakhand, Telangana, Odisha, Bengal, Jharkhand and Chandigarh and sought their reply within six weeks. A three-member bench headed by Chief Justice DY Chandrachud issued the notice on Monday, September 30, after hearing a petition filed by lawyer Savitri Pandey.
In the petition, lawyer Savitri Pandey has requested the court to implement the guidelines of the police reform decision of September 22, 2006 and has accused the court of not following the instructions for permanent appointment of DGP. Some states are violating the instructions for regular appointment. Even before the completion of their tenure, they are either transferred or appointed to another department and post. The petitioner says that such states should follow the Supreme Court decision and UPSC guidelines for permanent DGP appointment. It should also be ordered that they should not appoint acting DGP. Appoint acting or interim DGP only when absolutely necessary in special circumstances. In the police reform decision, the court had said that state governments will take advice from UPSC before appointing DGP. In which the panel of names of eligible people will be sent to UPSC three months before the retirement of the current DGP. UPSC will prepare a panel of three names for appointment to the post of DGP according to qualification, experience and seniority. The state government will appoint one of the panel. Irrespective of the date of retirement, the appointment will be for a minimum period of two years.
