New Delhi, 3 December (Hindustan Reporter). The Supreme Court has imposed a fine of Rs 50,000 on the Central Government for filing a petition against the decision of the Armed Forces Tribunal (AFT) to grant pension to the wife of a soldier killed during anti-terrorist patrolling in Jammu and Kashmir. A bench headed by Justice AS Oka said that Veer Baidhani’s widow should not have been dragged to court.
The court said that the authority that decided to appeal against the AFT decision should have been sympathetic towards the wife of the deceased soldier. The Supreme Court ordered the Central Government to impose a fine of Rs 50,000 and directed the Center to pay this amount of fine to Veer Baidhani’s wife within two months.
The case pertains to Naik Inderjeet Singh, who died of a heart attack while patrolling in bad weather in 2013. His death was initially classified as a casualty of war but was later reclassified as a physical accident due to military service. Inderjit Singh’s wife was given other benefits but was deprived of family pension. After that Inderjit Singh’s wife turned to AFT. AFT ordered to give family pension to Indrajit’s wife but this order of AFT was challenged by the Center in the Supreme Court.
