Delhi Chief Minister Arvind Kejriwal has got interim bail from the Supreme Court in the liquor scam case. But the matter of his arrest by the ED has been handed over to the larger bench of the Supreme Court. The bench of Supreme Court Justice Sanjeev Khanna and Justice Dipankar Dutta has sent the petition challenging Kejriwal's arrest to the larger bench. Now a three-judge bench of the Supreme Court will hear Kejriwal's petition. The Chief Justice will appoint three judges in this case. Kejriwal has been granted interim bail till the case remains with the larger bench. Due to this, Kejriwal will not be able to come out of jail. He is currently in CBI custody, but he has got bail in the ED case. In such a situation, now he will remain in jail.
The bench headed by Justice Sanjeev Khanna has referred the matter to a larger bench while deciding three questions in its decision. Kejriwal has challenged the order of the Delhi High Court, in which the lower court had upheld the summons issued to Kejriwal in the scam case. The court said that it cannot order Kejriwal to resign due to his arrest, it will be his own decision. The court also said that arrest cannot be allowed on the basis of interrogation alone. While granting interim bail to Kejriwal, he said that the Chief Minister of Delhi has been in jail for more than 90 days. He is an elected leader and he will decide whether he will remain in this post or not.
Let us tell you that Kejriwal had challenged the ED's arrest in the Delhi liquor policy case, on which the Supreme Court heard on May 17 and reserved the decision. Along with this, it was said that Kejriwal can go to the lower court for bail. Kejriwal had filed a petition in the Delhi High Court regarding his arrest and later being sent to ED custody. On April 9, the Delhi High Court justified Kejriwal's arrest. Kejriwal knocked the door of the Supreme Court against this decision.
