When the girl was taken to the hospital, the whole matter came to light. Here the wife gave birth to a child and the father went to jail. When this matter reached the High Court from the lower court, the judge again gave his verdict in this case.
The Delhi High Court has ordered to stop the criminal proceedings in the POCSO case on the petition of the petitioner boy. The High Court judge has said that if the FIR is not quashed, the lives of three people will be ruined. In which the lives of the husband-wife and the newborn child will also be ruined. The court has said in its order that it is passing the order on 'humanitarian grounds' due to 'extraordinary circumstances'.
During the hearing in the court, it came to light that the petitioner boy had fallen in love with a 17-year-old girl living in the neighborhood. After this, both of them got married of their own free will in August 2023. When the girl became pregnant, she was taken to the hospital.
Where the hospital people told the police that the girl was a minor. Later an FIR was registered against the boy under the Indian Penal Code (IPC) and Protection of Children from Sexual Offences (POCSO) Act. The girl gave birth to a boy in August and her husband was arrested in September.
What did the court say while dismissing the FIR?
Dismissing the case registered in Dwarka, Judge Anish Dayal said that considering these facts and circumstances, the court is of the opinion that the victim and the child live with their parents. The court said that the petitioner is an adult and if the FIR is not quashed, it will have an adverse effect on the child. Saying this, the court has dismissed the FIR registered against the accused.
