Stay on the order to disqualify Aklera Municipality President – ​​News India Live

Jaipur, 5 April (HS). The Rajasthan High Court has put an interim stay on the implementation of the order of the District Judge, under which the court had disqualified the Chairperson of Aklera Municipality of Jhalawar. A single bench of Justice Narendra Singh gave this order while conducting preliminary hearing on Vijay Lakshmi's petition.

In the petition, advocate Ajay Kumar Jain told the court that the petitioner, associated with the Congress, was elected to the post of President of Aklera Municipality. Whereas BJP's Kailashi Devi was defeated. On this, Kailashi Devi presented an election petition in the District Court and challenged the election of the petitioner. On behalf of Kailashi Devi, it was said that the petitioner's husband is working as a clerk in the municipality. In such a situation, Vijay Lakshmi was ineligible to contest the elections. Therefore his election should be cancelled. Hearing this, the District Court had canceled the election of the petitioner on March 21. The petition said that as per the rules, this order could have been challenged through appeal within a month, but the state government without waiting for the completion of the appeal period, the defeated candidate Kailashi Devi took charge. The petition said that on the basis of the husband or wife being a municipal employee, they cannot be declared ineligible to contest elections. In this case the fundamental rights of the petitioner have also been violated. Therefore, the order of the lower court should be stayed. Hearing which, the single bench has put an interim stay on the order of the lower court.
