Prayagraj, 09 May (HS). Allahabad High Court has stayed the implementation of the summon order issued by the CBI court against builder Naresh Somani in the land fraud case and has sought a reply from the CBI within six weeks.
Justice Sanjay Kumar Singh has given this order on the petition of builder Naresh Krishna Somani and others. CBI has filed a charge sheet in a case registered in a land buying and selling case in Kanpur city.
The petitioner's counsel, citing the Supreme Court's decision, said that in the crime of fraud there must be a victim. There is no victim in this case. Under the agreement to sell the land dated 22 February 2012, the entire amount has already been refunded to the person in whose favor the petitioners had entered into the agreement to sell the land. CBI has conducted a superficial investigation instead of an impartial investigation.
Senior counsel for CBI sought some time to file the counter affidavit. On which the court has stayed the summons till further orders and has given six weeks time to file the reply.
