The Allahabad High Court has reserved the order after completion of the arguments of both the parties on the petition filed demanding withdrawal of the order of 11 January 24 for simultaneous hearing of all the suits filed regarding the Mathura Shri Krishna Janmabhoomi-Shahi Idgah Masjid dispute.
Justice Mayank Kumar Jain heard the application of Shahi Idgah Masjid Committee on Wednesday. During this, the mosque side argued that the relief given in all the 15 suits is different and unequal. Therefore it would not be right to listen to them together. Each case should be heard separately according to the points of issue. And prayed the court to accept the recall application.
The court had ordered to hear together all the 15 suits filed regarding the Shri Krishna Bhoomi and Shahi Idgah Masjid dispute. After this, while hearing the maintainability of the cases, the court had rejected the objection of the mosque side and ordered to present the case to decide the points of issue.
On behalf of the mosque, Tasneem Ahmadi and Mahmood Pracha argued through video conferencing. Said that suits filed with different demands cannot be heard together. The order of clubbing all the suits is not maintainable, because consent has not been taken from all the parties. He prayed the court to withdraw the order to hear all the cases together.
There was opposition from the temple side. It was said that the court has the right to hear the suits filed on the same issue together. There is discretion to hear two or more suits by consolidating them. All the suits are related to removal of illegal encroachment from the Sri Krishna Janmabhoomi site and handing over the possession to Katra Keshav Dev.
Vishnu Shankar Jain, Reena N Singh etc. presented their views on behalf of the temple side. Advocate Mahendra Pratap Singh argued that the recall prayer has been filed to complicate the matter. A request was made to collect all the disputes and immediately decide the points of issue and hold the hearing. Ashutosh Pandey argued that the Muslim side wants that the points of issue should not be decided and the hearing of the case should be postponed. That is why various types of applications are being filed.
