Mumbai: The Nagpur bench of the Bombay High Court upheld the conviction of a man who raped his mother-in-law, saying it was a shameful act and the victim was like a mother to him.
Mrs. Samp said in the judgment that the victim was of the accused’s mother’s age and he had robbed the victim of her fox. The court said that the woman would never have imagined that her son-in-law would ever commit such a heinous act and she would have to live with such stigma for the rest of her life.
In March 2022, the Sessions Court sentenced the accused to 14 years imprisonment. The accused challenged the decision. In December 2018, he was accused of raping his 55-year-old mother-in-law.
The complainant alleged that his son-in-law and daughter were living separately and their two children were living with the son-in-law. On the day of the incident, the accused came to the victim’s house and quarreled with her and insisted on taking steps to reconcile with his wife. Due to pressure from the accused, the victim went to his house. On the way, the accused drank alcohol and allegedly raped the mother-in-law thrice.
The woman informed her daughter about the incident and a police complaint was lodged. The son-in-law claimed in the appeal that it was a consensual relationship and he has been wrongly implicated in the rape case.
Rejecting this argument, the High Court said that at the age of 55, no woman can put a wrong mark on her character.
Someone will have to lodge a complaint with the police and face the consequences. If the relationship had been consensual, he would not have filed a police complaint. If it was a matter of consent, he would not have told his daughter.
