Should women get period leave or not? SC refuses to hear the case, gives instructions to the Center

Women's period leave petition in Supreme Court: A petition demanding period leave for women has been filed in the Supreme Court. The petition demands that the Center, States and Union Territories should make a policy to give period leave to women. However, the Supreme Court has refused to hear this petition. But, in the meantime, the Supreme Court has directed the Central Government to decide a model policy by discussing with all the stakeholders and the states in this regard.

What did the court say?

In this regard, the Supreme Court said that it allows the petitioner to speak against the Secretary and ASG in the Ministry of Women and Child Development. Along with this, the Supreme Court directed the Secretary to consider this matter at the policy level and talk to all the parties, can any ideal policy be made in this regard? An appropriate decision should be taken on this. Chief Justice DY Chandrachud said that this leave encourages women to become a part of the workforce. Under these circumstances, making this leave mandatory will drive women away from the workforce. The Chief Justice said that the government should come forward to formulate a policy on this matter. He also said that this matter is part of the government's policy, on which the court should not interfere.

Advocate Shailendramani filed the petition

In fact, petitioner advocate Shailendramani Tripathi had sought a direction from the Supreme Court to the state governments to make rules for granting leave to women, citing the problems faced by women during menstruation. Section 14 of the Maternity Benefit Act, 1961 was cited in the petition and a demand was made to grant period leave to students and female employees.

Period leave is given in Bihar

The petitioner told the court that at present Bihar is the only state where women are given leave during menstruation under the 1992 policy.
