Sessions Court rejects bail of Santa Cruz woman accused

Mumbai: The sessions court here rejected the bail plea of ​​a woman who had allegedly killed her husband and mother-in-law by mixing poison in their food. Kavita Shah, a resident of Santa Cruz, allegedly killed her husband Kamalkant and mother-in-law Sarladevi by mixing poisons like arsenic and thallium in their diet.

Session Rajesh Sasane said that he played an important role in committing the crime. There is enough material against it. If released on bail, he can tamper with the evidence.

Deceased Kamal Kant fell ill, his condition became critical and he died on 19 September 2022. Kamalkant's mother Sarla had died a few days ago on August 13. Post mortem revealed that both of them died due to metal poisoning. Kamalkant's sister lodged a complaint with the police.

Both Kavita and her boyfriend were arrested on December 2, 2022. He has been falsely implicated in the case and not only was the complaint delayed but there is no evidence that he has committed the crime.

Opposing the bail plea, the prosecution said that the crime was pre-planned and also alleged that the relationship between the wife and husband was not cordial.

The court considered the evidence against the accused. She hesitated in getting her husband treated and even avoided getting her husband's blood tested. It was found that the symptoms of the deceased were present in his mother Saraladevi Shah before her death.

The judge said that the prosecution's claim that arsenic and thallium were used was weak. There is material on record which shows that heavy metals (arsenic and thallium) were found in the body of the deceased.

The court said that 'there is material on record to show that there was nexus between the petitioner and the co-accused to obtain this chemical for committing the offence.' The court further said that there is material on record to show the motive behind the crime and that the petitioner played an important role in committing the crime.
