Prayagraj, 09 December (HS). Allahabad High Court has postponed the ten years imprisonment awarded by the Sessions Court to the accused of kidnapping and raping a minor.
The court said that the accused has served more than four years of imprisonment. There is no possibility of the appeal against the sentence being heard soon. If the sentence is not postponed the appeal will be meaningless. While staying the remaining sentence, the court has ordered to present the bail bond and two securities before CJM Kaushambi.
Justice Manoj Bajaj has given this order on the application filed in the criminal appeal of Kamlesh Pasi. Satisfied with the explanation, the court waived the delay of 199 days in filing the appeal and accepted the appeal for consideration and summoned the original file.
Additional Sessions Judge Kaushambi has found the accused guilty and sentenced him to ten years imprisonment on charges of kidnapping and rape of a minor registered against him at Karari police station in Kaushambi. Which has been challenged in the appeal. The advocate says that there are many flaws in the decision of the Sessions Court. The appellant is lodged in District Jail Kaushambi. There is a possibility of his acquittal in appeal, hence the sentence should be suspended.
